Pass Drive Terms and Conditions
1.Legal:
1a. Pupils must be of legal age to drive and produce a valid UK/ Northern Ireland provisional category B photo card driving licence. For motorway, Pass Plus or refresher lessons a full valid licence must be produced with photographic identification if the old style paper licence is held.
1b. You must declare any points or driving convictions prior to tuition commencing.
1c. You must notify your instructor of any change of your ability to have driving tuition, for example if your provisional licence has been revoked or for medical reasons suspended.
1d. You must meet the minimum eye test requirements which require you to be able to read a standard UK approved number plate at a minimum distance of 20.5 metres (67 feet). If you need to wear glasses or contact lenses in order to meet this requirement then you must wear them whenever you drive.
1e. You must not be under the influence of alcohol/drugs during training. If your instructor detects signs of alcohol/drugs misuse, he/she will withhold the use of the training vehicle for tuition or driving test until you are in a legal and fit state to drive.
1f. Prescribed medication may also affect your driving. It is your responsibility to check the instructions or ask your pharmacist.
2. Lessons and payments:
2a. Your instructor will endeavour to arrive on time however, due to unforeseen circumstances such as breakdown, accidents, traffic holdups etc, lesson times may need to change or even be cancelled. If cancelled by your instructor, no fee will be charged.
2b. If your instructor turns up on time at the pre arranged pick up point and you do not show, your instructor will wait 10 minutes and if there is no contact made between you after 10 minutes the instructor will leave and you will have to pay in full for the lesson.
2c. Lessons can be paid for in advance by bacs or pay pal. Alternatively cash payments are accepted in the car prior to lessons commencing. Cheques are no longer accepted.
2d. Where discounts are offered for block bookings, these must be paid in advance by bacs/card or cash direct to your instructor.
2e. Block booked lessons cancelled before completion will incur an admin charge of £10. Lessons taken will be charged at the current single lesson rate.
2f. Gift vouchers have a maximum validity of Six calendar months
2g. Any introductory offers are for beginners or pupils with less than 10 hours driving experience.
Cancellations:
2h. 24 hours notice must be given if you wish to cancel or rearrange a lesson. This is to give the instructor time to fill this slot. Full payment for the lesson will be due if less than 24 hours notice is given.
3. Instructors:
3a. Your instructor is a self employed agent and after initial contact, your contract is directly with the instructor.
4. Tests:
4a. Should you fail to reach a satisfactory standard of driving and are likely to be a danger to other road users, or in an unfit condition through drug/alcohol abuse as described in section 1e above, your driving instructor has a responsibility to the DVSA examiners not to allow the use of the training vehicle for the purpose of the driving test. The DVSA guidelines do not allow for a pupil to take a practical test just for the experience.
4b. No responsibility can be accepted for tests cancelled by the DVSA for whatever reason. Lessons should be paid for but can be claimed back from the DVSA.
4c. No responsibility can be accepted for a failing a test due to being unable to pass the eyesight test.
4d. Your instructor will accept responsibility if the test is cancelled due to the condition of the tuition vehicle.
4e. When it is agreed with your Instructor that you are ready to book your driving test, the booking will be made on your behalf by Gears. A test date to suit your requirements may not be found due to availability, however all efforts will be made to book one as close to that date and time as possible.
4f. When booking your test electronically, an email address will be requested by the DVSA. Your Driving Test report will be sent to the submitted email address. You can use a personal email or use the central test report email address used by your Instructor.
